Terms of Service

Welcome to Mizwaj. By accessing, browsing, registering with, or using Mizwaj or any of its features, services, content, or functionality (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not access or use the Service.

1. Eligibility

The Service is strictly for adults aged 18 and over. You may use the Service only if you are at least 18 years old and legally capable of entering into a binding agreement under applicable law. Accounts for anyone under 18 are not permitted under any circumstances, and we terminate any account we believe belongs to a minor. See our Child Safety Standards.

You are responsible for ensuring that your use of the Service complies with all laws, rules, and regulations applicable to you.

2. Acceptable Use

You agree to use Mizwaj only for lawful and legitimate purposes.

You must not use the Service to:

• Commit, facilitate, promote, or attempt fraud, scams, deception, theft, or other unlawful activity.
• Impersonate another person, business, organization, or entity.
• Create false, misleading, deceptive, or fraudulent accounts, profiles, listings, information, or content.
• Harass, threaten, intimidate, abuse, defame, or harm another person.
• Send spam, unsolicited communications, phishing attempts, malicious links, or fraudulent messages.
• Attempt to obtain passwords, authentication information, payment information, personal information, or other sensitive information belonging to another person.
• Upload, transmit, distribute, or introduce viruses, malware, ransomware, spyware, malicious code, or other harmful material.
• Circumvent, disable, interfere with, or attempt to bypass security, authentication, access controls, rate limits, fraud-prevention systems, or other protective measures.
• Interfere with the operation, availability, security, or performance of the Service.
• Probe, scan, test, or attempt to discover vulnerabilities in the Service without express authorization.
• Access accounts, systems, information, or areas that you are not authorized to access.
• Use the Service to violate another person's privacy, intellectual property, contractual rights, or other legal rights.
• Use the Service for money laundering, payment fraud, financial deception, or other fraudulent transactions.
• Engage in conduct intended to manipulate, exploit, abuse, or deceive other users.
• Circumvent restrictions imposed on an account or attempt to return to the Service after suspension or termination through another account.
• Use the Service in a manner that could reasonably cause harm to Mizwaj, its users, systems, infrastructure, reputation, or third parties.

3. Bots, Automation, Scraping, and Data Collection

Unless Mizwaj expressly authorizes such activity, you may not use bots, scripts, crawlers, spiders, scrapers, automated agents, AI agents, automated browsers, data-mining tools, or other automated methods to access, collect, copy, monitor, index, download, reproduce, or interact with the Service or its content.

You may not use automated systems to:

• Create or operate accounts.
• Send messages or requests.
• Collect user information.
• Scrape or copy content.
• Circumvent usage restrictions or security measures.
• Generate artificial activity or engagement.
• Test or manipulate the Service.
• Overload or interfere with the Service.
• Extract data for commercial, competitive, training, analytical, or other purposes without authorization.

Mizwaj may use technical measures to identify, limit, block, or investigate automated or suspicious activity. However, you acknowledge that automated detection systems may not identify every unauthorized, fraudulent, malicious, or abusive activity.

The absence of detection or enforcement does not constitute permission to engage in prohibited activity.

4. User Accounts

If the Service allows you to create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You must provide information that is accurate, current, and not misleading.

You must not sell, transfer, rent, share, or otherwise provide access to your account to another person unless expressly permitted by Mizwaj.

You must notify Mizwaj if you reasonably believe that your account has been compromised or used without authorization.

5. User Content

If you submit, upload, post, transmit, or otherwise provide content through the Service ("User Content"), you are responsible for that content and for ensuring that you have the necessary rights and permissions to provide it.

You must not submit content that is unlawful, fraudulent, deceptive, abusive, threatening, defamatory, invasive of privacy, infringing, malicious, or otherwise prohibited by these Terms.

To the extent necessary to operate, maintain, secure, improve, and provide the Service, you grant Mizwaj the permissions reasonably required to process and display your User Content in connection with the Service.

Mizwaj does not guarantee that User Content will be monitored, reviewed, verified, or detected for every violation.

6. Fraud, Scams, and Suspicious Activity

Mizwaj may investigate activity that it reasonably believes may involve fraud, scams, abuse, deception, unauthorized access, manipulation, or other prohibited conduct.

Mizwaj may, where appropriate and permitted by law:

• Restrict or remove content.
• Limit functionality.
• Delay, reject, or cancel activity.
• Suspend or terminate accounts.
• Block devices, IP addresses, identifiers, or other access methods.
• Preserve information relating to suspected misuse.
• Cooperate with law enforcement, regulators, service providers, or other authorized parties.
• Take other reasonable measures to protect Mizwaj, its users, and third parties.

Mizwaj does not guarantee that fraudulent, deceptive, malicious, or abusive activity will always be identified or prevented.

7. Suspension and Termination

Mizwaj may suspend, restrict, terminate, or limit your access to the Service at any time where Mizwaj reasonably believes that:

• You violated these Terms.
• Your activity may create a security, legal, financial, operational, or reputational risk.
• Your activity may harm another user or third party.
• Your account or activity may be fraudulent, deceptive, automated, abusive, or unauthorized.
• Action is necessary to protect the Service or its users.
• Action is required by law, regulation, legal process, or a third party with appropriate authority.

Where appropriate and legally permissible, Mizwaj may take action without prior notice when immediate action is reasonably necessary.

Termination or suspension does not eliminate obligations that by their nature should continue after termination.

8. Intellectual Property

The Service and its original content, design, software, trademarks, branding, features, and other materials are owned by or licensed to Mizwaj unless otherwise stated.

You may not copy, reproduce, modify, distribute, sell, license, reverse engineer, exploit, or create derivative works from the Service or its protected materials without appropriate authorization.

9. Third-Party Services and Content

The Service may contain links, integrations, advertisements, services, or content provided by third parties.

Mizwaj does not necessarily control or endorse third-party services and is not responsible for their availability, accuracy, security, practices, or conduct.

Your use of third-party services may be subject to separate terms and privacy policies.

10. Privacy, Cookies and Analytics

Our Privacy Policy and Cookie Policy explain what information we collect, why we collect it, who we share it with, and the choices available to you. Both form part of these Terms, and by using the Service you agree to them as well.

We use a third-party product analytics provider to understand how the Service is used and where it fails. We do not send the content of your messages, voice notes or calls, your photographs, or your identity verification documents to that provider. Where the law requires your consent before analytics information is collected, we ask for it first and collect nothing until you agree. The detail, including how to withdraw a consent you gave, is in section 13 of the Privacy Policy.

11. Disclaimer

The Service is provided on an "as available" and "as is" basis to the maximum extent permitted by applicable law.

Mizwaj does not guarantee that the Service will always be available, uninterrupted, secure, accurate, complete, error-free, or free from harmful components.

Mizwaj does not guarantee that all fraudulent, abusive, malicious, deceptive, automated, or unauthorized activity will be detected or prevented.

You acknowledge that internet-based services involve risks, including security risks, technical failures, third-party failures, unauthorized activity, and events outside Mizwaj's reasonable control.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Mizwaj and its operators, affiliates, service providers, licensors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, business opportunities, reputation, or other intangible losses arising from or related to your use of, or inability to use, the Service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

13. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Mizwaj and its operators, affiliates, service providers, licensors, and representatives from claims, liabilities, damages, losses, costs, and expenses arising from or related to:

• Your use or misuse of the Service.
• Your violation of these Terms.
• Your User Content.
• Your violation of applicable law or the rights of another person or entity.
• Fraudulent, deceptive, abusive, unauthorized, or unlawful activity conducted through your account or access to the Service.

14. Subscriptions, Purchases and Auto-Renewal

Mizwaj offers auto-renewable subscriptions and one-time purchases such as Super Likes, Direct Messages and Spotlight. All payments are processed by the Apple App Store or Google Play, which act as merchant of record. Mizwaj does not take your payment details.

• A subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account is charged within 24 hours before renewal.
• Cancel on iOS under Settings › Apple ID › Subscriptions, or on Android in Google Play under Payments and subscriptions. Deleting the app does not cancel a subscription.
• One-time purchases are delivered to your account immediately, are consumed as you use them, have no cash value and cannot be transferred, exchanged or reinstated.
• If we change a price we will give notice, and the change applies from your next renewal. Continuing after that renewal is acceptance.

15. Refunds

Because Apple and Google process payments, refund requests are handled by them and not by Mizwaj. On iOS use reportaproblem.apple.com; on Android use the Google Play order history. Where local consumer law gives you a right to cancel or withdraw, that right applies and nothing here limits it. We do not refund purchases on accounts terminated for breach of these Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you mandatory local consumer protection, nothing in these Terms deprives you of that protection and you may bring proceedings before your local courts. We encourage you to contact us at contact@rinly.com first so we can try to resolve the matter directly.

17. Changes to These Terms

Mizwaj may modify these Terms from time to time.

Updated Terms become effective when posted unless a different effective date is stated. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms to the extent permitted by law.

18. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.

19. Entire Agreement

These Terms, together with any policies expressly incorporated into them, constitute the agreement governing your use of the Service, subject to applicable law.
